Terms and Conditions for Index Classifieds

Index Classifieds ("we," "us," "our," or "the Platform") is a division of Setpiece Group. These Terms and Conditions ("Terms") govern your use of the Index Classifieds website, services, and mobile applications (collectively, the "Service").

By accessing or using Index Classifieds, you agree to be bound by these Terms. If you do not agree, do not use our Service.

1. Our Purpose

Index Classifieds was launched in 2020 to help local businesses trade faster. We connect buyers and sellers through targeted classifieds designed to cut deal time and reduce friction. Our focus is simple: help businesses get seen by the right people, and give buyers a trusted place to find what they need.

2. Eligibility

You must be a business entity or an individual acting on behalf of a registered business to post listings. Individual consumers may browse and contact sellers but may not post commercial listings unless authorized.

By using Index Classifieds, you represent that you:

• Are at least 18 years old.

• Have the authority to bind your business to these Terms.

• Will comply with all applicable local, national, and international laws.

3. User Accounts

To post a classified ad, you must register an account. You agree to:

• Provide accurate, current, and complete information.

• Keep your login credentials confidential.

• Notify us immediately of any unauthorized account access.

We reserve the right to suspend or terminate accounts that violate these Terms.

4. Posting Listings (For Sellers)

When you post a listing on Index Classifieds, you agree that:

• Accuracy: All descriptions, prices, images, and locations must be truthful and not misleading.

• Legality: You will not list prohibited items (see Section 5 below).

• No Duplicates: You will not post duplicate listings or spam the Platform.

• Timeliness: You will mark items as sold or remove listings promptly after a deal is closed.

5. Prohibited Items and Conduct

To maintain trust and reduce friction, the following are prohibited on Index Classifieds:

Conduct: You may not scrape data, use bots, send spam, or attempt to bypass our safety systems.

6. For Buyers

Index Classifieds is a platform connecting local buyers and sellers. We do not:

• Verify the quality, safety, or legality of every listing.

• Handle payments or provide escrow services.

• Guarantee that a seller will complete a transaction.

You are responsible for:

• Inspecting items before purchase (where possible).

• Using safe, in-person meeting practices (public places, bring a friend).

• Reporting suspicious or fraudulent listings to us immediately.

Tip to cut deal time: Communicate clearly, arrange pickup quickly, and close locally.

7. Role of Index Classifieds & Setpiece Group

Index Classifieds acts as a neutral marketplace. We are not a party to any agreement between buyers and sellers.

We do not:

• Warrant title, condition, or merchantability of any listed item.

• Resolve disputes between users (though we may ban bad actors).

• Offer refunds for transactions conducted off-platform.

Our responsibility is to maintain a functioning, fast, and targeted classifieds service. Setpiece Group provides operational and legal backing but is not liable for user-to-user transactions.

8. Intellectual Property

• Our Content: All design, logos, text, and code on Index Classifieds are owned by Setpiece Group. You may not copy or reuse without permission.

• Your Content: You retain ownership of your listing text and images. By posting, you grant us a non-exclusive, royalty-free license to display, distribute, and promote your listing on Index Classifieds and related marketing channels.

9. Termination

We may suspend or terminate your access immediately if you:

• Violate these Terms or applicable laws.

• Post prohibited items or engage in fraudulent conduct.

• Create excessive friction for other users (e.g., ghosting buyers, relisting sold items).

You may delete your account at any time. Listings will be removed upon account deletion.

10. Disclaimers and Limitation of Liability

"As Is" Basis: The Service is provided without warranties of any kind. We do not guarantee that every listing will result in a fast trade or that buyers will find what they need.

Limitation of Liability: To the maximum extent permitted by law, Index Classifieds and Setpiece Group shall not be liable for any indirect, incidental, or consequential damages arising from:

• Transactions between users.

• Reliance on listing accuracy.

• Delays caused by third parties.

Maximum Liability: In no event shall our total liability exceed $100 USD or the fees you paid us in the prior 6 months, whichever is less.

11. Indemnification

You agree to indemnify and hold harmless Index Classifieds and Setpiece Group from any claims, losses, or damages arising from:

• Your violation of these Terms.

• Your listing or sale of any item.

• Your dispute with another user.

12. Modifications to Terms

We may update these Terms from time to time. Material changes will be notified via email or website banner. Continued use after changes constitutes acceptance.

13. Governing Law
